Ausgel\u00f6st wurde das Verfahren durch eine Klage \u00f6sterreichischer Verbrauchersch\u00fctzer gegen die Deutsche Bahn. Diese hatte es bisher nur Kunden mit deutschen Konten gew\u00e4hrt, ihre Tickets mittels SEPA-Lastschriftverfahren zu zahlen.<\/p>\n<h3>Die verschiedenen Positionen<\/h3>\n<p>Die\u00a0<em>Deutsche Bahn\u00a0<\/em>st\u00fctzte ihre bisherigen Praktiken insbesondere darauf, dass Kunden mit ausl\u00e4ndischen Konten immer noch weitere Zahlungsverfahren wie etwa PayPal, via Kreditkarte oder mittels Sofort\u00fcberweisung zur Verf\u00fcgung stehen. Ebenfalls sei die bei Lastschriftverfahren notwendige Bonit\u00e4tspr\u00fcfung bei Kunden mit ausl\u00e4ndischen Konten erheblich erschwert. Aufgrund des hohen Ausfallsrisikos bei diesem Zahlungsverfahren k\u00f6nne man jedoch nicht g\u00e4nzlich auf eine Pr\u00fcfung verzichten.<\/p>\n<p>Im \u00dcbrigen k\u00f6nne aus der f\u00fcr die Klage der Verbrauchersch\u00fctzer grundlegenden\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=CELEX:32012R0260&amp;from=DE\" target=\"_blank\" rel=\"noopener noreferrer\">Verordnung\u00a0Nr.\u00a0260\/2012<\/a>\u00a0kein Wohnsitzerfordernis wie das in Rede stehende abgeleitet werden.<\/p>\n<p>Die <em>\u00f6sterreichischen Verbrauchersch\u00fctzer<\/em>\u00a0entgegneten, dass\u00a0ein Unternehmen dem Verbraucher beim SEPA-Lastschriftverfahren nicht vorschreiben d\u00fcrfe, in welchem Land er sein Konto zu f\u00fchren habe. Indem die Deutsche Bahn jedoch in den eigenen Bef\u00f6rderungsbedingungen festlege, dass im Falle einer Zahlung per Lastschrift ein deutscher Wohnsitz notwendig sei, schreibe sie indirekt auch vor, dass der Kunde ein deutsches Konto f\u00fchren m\u00fcsse.<\/p>\n<h3>EuGH: SEPA-Lastschriftzahlung nicht nur f\u00fcr Inl\u00e4nder!<\/h3>\n<p>Der EuGH gab den Verbrauchersch\u00fctzern Recht.<\/p>\n<p>Sinn der <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=CELEX:32012R0260&amp;from=DE\" target=\"_blank\" rel=\"noopener noreferrer\">Verordnung<\/a>\u00a0sei gerade, dass es Verbrauchern erm\u00f6glicht werde, nur ein einziges Konto bei Lastschriftzahlungen zu nutzen. Hintergrund daf\u00fcr sei die Vermeidung von unn\u00f6tigen Kontof\u00fchrungsgeb\u00fchren.<\/p>\n<p>Weiter komme es nicht darauf an, dass dem Verbraucher andere Zahlungsm\u00f6glichkeiten zur Verf\u00fcgung stehen. Sobald ein Unternehmer das Lastschriftverfahren anbiete, d\u00fcrfe er die Nutzung nicht von bestimmten Voraussetzungen abh\u00e4ngig machen.<\/p>\n<p>Auch zum Einwand der Bonit\u00e4tspr\u00fcfung \u00e4u\u00dferte sich der EuGH. Insofern sahen die Richter im Missbrauchs- oder Zahlungsausfallsrisiko zwar grunds\u00e4tzlich ein Problem. Allerdings verwiesen sie die Deutsche Bahn auf die M\u00f6glichkeit, den Zugang zu den Tickets davon abh\u00e4ngig zu machen, ob der Einzug der Zahlung erfolgt ist oder nicht.<\/p>\n<h3>Fazit<\/h3>\n<p>Das Urteil ist insgesamt \u00fcberzeugend und wenig \u00fcberraschend. Die Begrenzung von Zahlungsm\u00f6glichkeiten auf Wohnorte ist schlichtweg nicht mit dem Selbstverst\u00e4ndnis der EU vereinbar.<\/p>\n<p>Nat\u00fcrlich gilt dieses Urteil nicht nur f\u00fcr die Deutsche Bahn, sondern erstreckt sich auf alle Online-Shops.
